The services provided by Big Smile Luxury Charters, the owner of the website, are subject to the following conditions:


General conditions

These conditions contain some exclusions and limitations of liability. The user accepts that the use of this website does not imply any relationship of association, partnership or agency relationship between the user and www.bigsmilecharters.com. The reservation on this website and, by extension to the rest of the channels, is conditioned to the acceptance of the terms and conditions. If you do not agree with any clause, do not continue with the reservation process. If the reservation is completed, the user agrees to have read and accepted the conditions of use. If there is any part that you do not understand well or if you have questions about the service, we invite you to contact us by email or phone.

Observation of cetaceans and marine fauna

They are found in their natural habitat in the southern waters of the island of Tenerife and their observation is very likely, but never assured. It is always navigated trying to avoid discomfort to the marine fauna and complying with the precepts of the Sustainability Charter to which the company is attached. The participants must attend with interest to the skipper and sailor of the boat in order to follow their instructions and instructions at all times.

Port of departure and return

Except for reasons of force majeure other than Big Smile or special requests for private charters, the port of departure and arrival of the Big Smile is Marina Puerto Colón, Costa Adeje (Tenerife).

Times and punctuality

Maximum punctuality is requested from passengers. You must show up 15 'in advance at the entrance of Pier 2 in Puerto Colón. The wait of the boat is not guaranteed if a passenger arrives later than the scheduled presentation time. The advertised excursions have an approximate duration, depending on the state of the sea and the possible imponderables that may arise during the same. Big Smile is not responsible, nor will be subject to any claim, if the duration is not exactly set in the public communication.


How to book the service

You must fill in the booking form on the website and pay the full amount of the reservation. The person filling in the reservation module page does so on behalf of all the members of the group that participate in the service, this will confirm that the people who belong to it accept the reservation conditions. This person undertakes to transfer to the other members any information received from Big Smile regarding changes, cancellations or conditions of service. After receiving the reservation of the tour, Big Smile will confirm it by email. Until the payment has been confirmed there will be no contract with the client.

Cancellation of the reservation

You need JavaScript enabled to view it. with the request for cancellation up to 48 hours before the departure of the tour. In this case, 100% of the total amount of the reservation will be refunded. In the case of cancellation less than 48 hours from the date of service, no amount will be refunded. In case of cancellation of an excursion due to technical reasons, force majeure or due to poor state of the sea, Big Smile will offer you an alternative day or refund the total amount to the client. When it comes to charter or events, the cancellation period is up to 7 days before the booked or contracted date, between 15 and 7 days will be paid 50% of the service and with 6 days or less, no amount will be refunded .

Change of conditions

Big Smile reserves the right to change the service schedule for reasons beyond the control of the company. Big Smile reserves the right to modify these terms and conditions at any time and without prior notice. The use of this website will be subject to the general conditions in force at the time of its use.

Responsibility

The customer guarantees to be of legal age and have the legal capacity to contract with Big Smile and to accept the obligations set by law for any liability arising from the use of this website.

The client guarantees that all personal information sent during the reservation process of services / s are correct and assumes financial responsibility for all transactions carried out in his name or charged to his account.

The lessee is obliged to make good use and keep the boat and all its elements as if they were his property, scrupulously complying with current legislation and with respect to the instructions of the different Maritime Captaincies.

The Skipper is the highest authority on board. He is the only responsible for the government and security of all passengers. The decisions you make for the benefit of safety or coexistence on board can not be questioned by any passenger. The Skipper is authorized to disembark those passengers who endanger their safety and / or that of others.

The number of passengers is limited to the number of authorized places.

The leased vessel is insured at all risk and has all the permits and authorizations to exercise this activity.

The itineraries can undergo modifications, both in terms of route and place of embarkation and disembarkation, as well as the schedules and days of departure, due to possible adverse weather conditions or fortuitous breakdowns. These modifications will not give any right to compensation.
