The services provided by Big Smile Luxury Charters, owner of the website, are subject to the following conditions:
General terms and conditions
These terms and conditions contain certain exclusions and limitations of liability. You agree that your use of this site does not imply any partnership, association or agency relationship between you and www.bigsmilecharters.com.
Booking on this website and, by extension to other channels, is conditional upon acceptance of the terms and conditions. If you do not agree with any clause, do not continue with the booking process. If the booking is completed, the user agrees to have read and accepted the terms and conditions of use. If there is any part that you do not understand or if you have questions about the service, we invite you to contact us by email or telephone.
Cetacean and marine wildlife watching
They are found in their natural habitat in the waters of the south of the island of Tenerife and their observation is very likely, but never guaranteed. We always sail trying to avoid disturbing the marine fauna and complying with the precepts of the Sustainability Charter to which the company adheres.
Participants must listen with interest to the skipper and sailor of the boat in order to be able to follow their indications and instructions at all times.
Port of departure and return
Except in cases of force majeure beyond Big Smile's control or special requests for private charters, the port of departure and arrival of the boats is Marina Puerto Colón, Costa Adeje (Tenerife).
It will always be carried out with a qualified driver and an insured vehicle that complies with all European safety regulations.
The places available on board are limited (11), we recommend you to book in advance.
Timing and punctuality
Passengers are requested to be punctual. Please arrive 15′ in advance at the entrance to pontoon 2 in Puerto Colón. If a passenger arrives later than the scheduled check-in time, there is no guarantee that the boat will wait for him/her.
To avoid delays in picking up passengers, customers will not be picked up or set down on the route except in very justified cases.
Those who miss the boat, or the transport in case of pick-up, will not be entitled to a refund.
The excursions advertised have an approximate duration, depending on the state of the sea and the possible imponderables that may arise during the excursion. Big Smile accepts no liability and will not be liable for any claims if the duration is not exactly as stated in the public announcement. The same applies to charters. The events will be subject to a contract adapted to the reality of each event.
How to book the service
The booking form must be filled in on the website and the total amount of the booking must be paid. The person who fills in the booking form page does so on behalf of all the members of the group participating in the service, this will ratify that the persons belonging to the group accept the booking conditions.
This person agrees to pass on to the other members any information received from Big Smile regarding changes, cancellations or conditions of service.
After receipt of the tour booking, Big Smile will confirm the booking by email. Until the payment has been confirmed, no contract with the client exists.
Cancellation of the reservation
An email must be sent to firstname.lastname@example.org with the cancellation request up to 72 hours before the departure of the excursion. In this case, 100% of the total amount of the booking will be refunded. In case of cancellation less than 72 hours before the date of the service, no amount will be refunded.
In case of cancellation of an excursion due to technical reasons, force majeure or bad sea conditions, Big Smile will offer an alternative day or reimburse the customer in full.
In the case of charters or events, the cancellation period is up to 15 days before the booked or contracted date, between 15 and 7 days 50% of the service will be paid and with 6 days or less, no amount will be refunded.
Change of conditions
Big Smile reserves the right to change the timetable of the service for reasons beyond the company's control.
Big Smile reserves the right to change these terms and conditions at any time without notice. Use of this website is subject to the terms and conditions in force at the time of use.
The customer guarantees to be of legal age and to have the legal capacity to contract with Big Smile and to accept the obligations established by law for any liability arising from the use of this website.
The customer guarantees that all personal information submitted during the service/s booking process is correct and assumes financial responsibility for all transactions made in his/her name or charged to his/her account.
Big Smile, acting in good faith, assumes no responsibility for any typographical errors or omissions on this site.
Big Smile cannot guarantee that this website and the emails sent are free of viruses or other potentially harmful components for your PC. Www.bigsmilecharters.com cannot be held liable for damages of any kind arising from the use of this website.
Big Smile is the owner of this website. It is not possible to use the contents of this website for the benefit of third parties without the express authorisation of the company.
All contents are protected by applicable national and international copyright laws.
Any dispute shall be subject to the jurisdiction and laws of the Spanish courts.
The lessee is obliged to make good use of and maintain the boat and all its elements as if they were his own property, scrupulously complying with current legislation and respecting the instructions of the different Maritime Authorities.
The skipper is the highest authority on board. He is solely responsible for the governance and safety of all passengers. The decisions he makes in the interests of safety or coexistence on board may not be questioned by any passenger. The Skipper is empowered to disembark passengers who endanger their safety and/or the safety of others.
The number of passengers is limited to the number of authorised seats.
The rented boat is fully insured and has all the permits and authorisations required for this activity.
Itineraries may be modified, both in terms of the route and the place of embarkation and disembarkation, as well as the times and days of departure, due to possible adverse weather conditions or fortuitous breakdowns. These modifications will not give any right to compensation.
