The services provided by Big Smile Luxury Charters, owner of the website, are subject to the following conditions:
GENERAL CONDITIONS
These conditions contain some exclusions and limitations of liability. The user accepts that the use of this website does not imply any association, partnership or agency relationship between the user and www.bigsmilecharters.com. The reservation on this website and, by extension to the rest of the channels, is conditioned on the acceptance of the terms and conditions. If you do not agree with any clause, do not continue with the booking process. If the reservation is completed, the user accepts to have read and accepted the terms of use. If there is any part that you do not understand well or if you have questions about the service, we invite you to contact us by email or telephone.
CETACEAN AND MARINE FAUNA WATCHING
They are found in their natural habitat in the waters of the south of the island of Tenerife and their observation is very probable, but never assured. They are always sailed trying to avoid disturbing the marine fauna and complying with the precepts of the Sustainability Charter to which the company is adhered. The participants must pay attention to the skipper and sailor of the boat in order to follow their indications and instructions at all times.
PORT OF DEPARTURE AND RETURN
Except for force majeure beyond Big Smile or special requests for private charters, the port of departure and arrival of the Big Smile is Marina Puerto Colón, Costa Adeje (Tenerife).
PLACES
The places available on board are limited (11), we recommend you to book in advance.
TIMING AND PUNCTUALITY
Passengers are requested to be as punctual as possible. Please arrive at 15′ in advance at the entrance of pontoon 2 in Puerto Colón. There is no guarantee that the boat will be waiting if a passenger arrives later than the scheduled time. The advertised excursions have an approximate duration, depending on the state of the sea and the possible imponderables that may arise during the same. Big Smile will not be responsible, nor will it be subject to any claim, if the duration is not exactly the one fixed in the public communication.
HOW TO BOOK THE SERVICE
You must fill in the reservation form on the website and pay the total amount of the reservation. The person who fills in the booking form page does so on behalf of all the group members participating in the service, this will confirm that the people belonging to the group accept the booking conditions. This person agrees to pass on to the other members any information received from Big Smile regarding changes, cancellations or conditions of service. Upon receipt of the tour booking, Big Smile will confirm the booking by email. Until the payment has been confirmed there is no contract with the client.
CANCELLATION OF A RESERVATION
An email should be sent to bigsmilecharters@gmail.com with the request for cancellation up to 48 hours before the departure of the tour. In this case, 100% of the total amount of the reservation will be refunded. In the case of cancellation less than 48 hours before the date of the service, no amount will be refunded. In case of cancellation of a tour due to technical reasons, force majeure or bad sea conditions, Big Smile will offer an alternative day or refund the full amount to the client. In the case of charters or events, the cancellation period is up to 7 days before the booked or contracted date, between 15 and 7 days 50% of the service will be paid and with 6 days or less, no amount will be refunded.
CHANGE IN CONDITIONS
Big Smile reserves the right to change the service schedule for reasons beyond the company's control. Big Smile reserves the right to change these terms and conditions at any time without notice. The use of this website will be subject to the general conditions in force at the time of use.
RESPONSIBILITY
The client guarantees to be of legal age and to have the legal capacity to contract with Big Smile and to accept the obligations set by law for any liability arising from the use of this website. The client guarantees that all personal information submitted during the booking process is correct and assumes financial responsibility for all transactions made on his/her behalf or charged to his/her account.
Big Smile, acting in good faith, assumes no responsibility for any typographical errors or omissions on this site. Big Smile cannot guarantee that this website and the emails sent are free of viruses or other potentially dangerous components for your PC. Www.bigsmilecharters.com cannot be held responsible for any damage of any kind arising from the use of this website. Big Smile is the owner of this website. It is not possible to use the contents of this website for the benefit of third parties without the express permission of the company. All contents are protected by the current national and international copyright regulations. Any dispute will be subject to the jurisdiction and laws of the Spanish courts.
The lessee is obliged to make good use of and maintain the boat and all its elements as if they were his own, complying scrupulously with current legislation and with respect for the instructions of the various Maritime Authorities. The Skipper is the highest authority on board. He is solely responsible for the steering and safety of all passengers. The decisions he takes for the benefit of safety or coexistence on board may not be questioned by any passenger.
The Skipper is entitled to disembark those passengers who endanger their safety and/or that of others. The number of passengers is limited to the number of authorised seats. The rented boat is fully insured and has all the permits and authorisations to carry out this activity.
Itineraries may be modified, both in terms of the route and the place of embarkation and disembarkation, as well as the times and days of departure, due to possible adverse weather conditions or fortuitous breakdowns. These modifications will not give any right to compensation.
